California resident Richard H. Davis, a consumer watchdog, has initiated a class action antitrust case against McDonald's Corporation ("McDonald's") alleging deceptive marketing practices related to its McRib BBQ pork sandwich. Davis asserts that McDonald's has been engaging in a "bait and switch" tactic with regards to the availability of the McRib since its introduction in 1981.
The lawsuit, filed in California, highlights the discrepancy between McDonald's marketing claims and the actual availability of the McRib sandwich. Despite the company's advertisements promoting the return of the McRib, consumers have reported difficulties in actually purchasing the product at various McDonald's locations.
According to McDonald's own website, the McRib is described as a seasonal item, with promotions often emphasizing its limited-time availability. However, Davis argues that the scarcity of the McRib is not due to genuine supply constraints but rather a deliberate marketing strategy designed to create artificial demand.
"McRib's number one fan may be Xanthe Pajarillo, who became a cult hero in 2015 on TikTok when she addressed the Santa Clarita council in California to ask for the return of the McRib to her local McDonald's store," explained Davis. "After a year of fighting, the McRib was back in Santa Clarita McDonald's in time for Thanksgiving 2016. The boneless pork meat used to form the McRib patty is identical to SPAM luncheon meat, simply covered in barbecue sauce. Why all the hype?" questioned Davis.
Richard H. Davis, the plaintiff in the case, is a well-known figure in consumer advocacy circles. He is a prolific inventor, a United States Merchant Marine, and a combat veteran. Davis's experiences during the United States Invasion of Panama, chronicled in his unpublished manuscript "Sailor of Fortune," provide insight into his commitment to justice and transparency.
